Terms of Use

These Terms of Use (the "Terms") are an electronic agreement between LAICOS Bilişim Yazılım ve Bilgi Sistemleri İthalat İhracat Limited Şirketi, which provides services under the PriceONN brand ("PriceONN", the "Company", "we"), and the individual who uses the PriceONN services ("User", "you").

The Terms cover the website at priceonn.com, the PriceONN iOS and Android apps, the programming interfaces used by these clients, e-mail and push notifications, and all content and features provided through them (the "Service").

The following documents form part of these Terms: the Privacy Policy, the KVKK and GDPR Notice, the Cookie Policy, the Community Rules, the Disclaimer and the Data Retention and Deletion Policy. If they conflict, the Privacy Policy and the KVKK and GDPR Notice prevail on matters of personal data and these Terms prevail on all other matters.

By ticking the box when you create an account, signing up with your Google or Apple account, or continuing to use the Service without an account, you confirm that you have read and accept these Terms. If you do not accept them, do not use the Service.

Account

Your personal user account, opened with e-mail and password or with Google or Apple, that gives access to the members-only parts of the Service.

Free plan

The level of use offered free of charge to everyone who opens an account, with the limits shown on the pricing page.

Paid plan

The Pro and Premium plans: subscriptions offered for a fee for a set period and renewed automatically.

Enterprise plan

Company use whose scope, term and fee are set in a separate written agreement between the parties.

Market data

Prices, exchange rates, indices, candles (OHLC) and the indicators, patterns and summaries derived from them that are shown in the Service.

Algorithmic signal

A "bullish setup" or "bearish setup", with its levels and probability values, generated automatically by rule-based methods and statistical models and shown the same way to everyone.

User content

Any content you create, such as community posts, replies, profile details, profile image, saved chart drawings and notes.

Seller

Creem (creem.io), the payment company that sells, collects payment for, invoices and handles taxes on paid plans in its own name.

Store

The Apple App Store or Google Play, from which the mobile app is downloaded.

You must be at least 18 years old and legally able to enter into a contract to become a member. We close the accounts of people we learn are under 18.

• You are responsible for keeping the information you give at sign-up accurate and current. If your e-mail address changes, update it in your account settings.
• Your account is personal. It cannot be transferred, sold or shared, and one person may not use several accounts to get around the rules.
• You are responsible for the security of your password and of the devices you sign in on. If you notice unauthorised use, change your password, close open sessions from your account page and write to us straight away.
• When you sign in with Google or Apple, that provider's own terms also apply. If you lose access to the provider account, you can set a password so you can still reach your account with e-mail and password.
• Your username may not impersonate another person, brand or organisation and may not be misleading, insulting or unlawful. We may change such a username.

PriceONN is a market information platform that offers prices, charts, technical indicators, pattern scanning, watchlists, price alerts, an economic calendar and community features for currencies, commodities, precious metals, indices and crypto assets.

PriceONN is not a broker, investment firm, exchange, payment institution or crypto asset service provider. You cannot place orders through the Service, and we do not hold money or assets or open trading accounts.

• Market data is compiled from third-party sources. Some prices are delayed rather than real time. Free market (Grand Bazaar) gold and currency prices in Turkey are indicative and are not the dealing price of any institution.
• Data may be incomplete, delayed or wrong because of provider failures, network delays, closed markets or calculation errors. Do not treat a price shown in the Service as the price at which a trade will be executed; confirm prices with your broker before trading.
• Technical indicators, pattern detections and summary sentences are the factual output of algorithms applied to past price data. They are not a forecast, guarantee or recommendation about future prices.
• Artificial intelligence is used for translation between Turkish and English, for processing market data and for generating and explaining algorithmic signals. Published articles are reviewed by our team before publication. PriceONN's algorithmic signals are automatically generated, general technical setup information; they are not instructions to buy, sell or hold, nor definite price forecasts.
• Features, supported symbols and plan limits may change over time. The current limits are on the pricing page.

Nothing in the Service, including information, charts, indicators, technical ratings, patterns, algorithmic signals, alerts, articles and community posts, is investment advice, portfolio management or a recommendation to buy or sell any financial instrument within the meaning of Turkish Capital Markets Law No. 6362 or any other law.

Investment advice is provided only under an investment advisory agreement with a licensed firm, such as a brokerage house, portfolio management company or non-deposit bank. Information in the Service may not suit your financial situation or your risk and return preferences, and decisions based only on it may not give the results you expect.

Algorithmic signals are general in nature and not personal; they contain no instruction to buy, sell or hold and no position size or leverage suggestion. Probability values and past performance are no guarantee of future results. How signals are generated and their limits are explained on the Disclaimer page.

Leveraged trading, forex and crypto assets carry high risk and can lead to the loss of all the money you invest. You alone are responsible for your investment decisions and their results. See the Disclaimer page for more.

Price alerts and pattern notifications are evaluated on our servers and sent through the channels you choose: the on-site inbox, browser notifications, mobile push notifications and e-mail.

• Whether a notification reaches you depends on the notification permissions of your device and browser, on the notification services run by Apple, Google and browser makers, on your e-mail provider and on your internet connection. Some of these links are outside our control.
• We therefore cannot guarantee that notifications will be delivered on time, in full or at all. A notification shown as sent has not necessarily reached your device.
• Alerts trigger on the data available when they are evaluated. In fast markets the trigger price can differ from the alert level.
• Do not rely on alerts and notifications as your only risk management tool. Place protective orders such as stop losses with your broker.

Most of the Service is free. The Pro and Premium plans offer higher usage limits and extra features. The content and price of each plan are those shown on the pricing page at the time you pay.

Seller and payment

• Paid plans are sold by Creem acting as seller (Merchant of Record). Payment is taken on Creem's secure checkout page, Creem issues the invoice and collects any taxes due on the sale, and Creem's terms of sale also apply to your purchase.
• Your card details never reach PriceONN servers and are not stored by PriceONN. Creem only tells us what we need to manage your subscription: customer and subscription IDs, plan, billing period, status, amount and currency.
• Prices are in US dollars (USD) and include taxes; Creem calculates the tax due on the sale from within this amount. Your card issuer may charge currency conversion or foreign transaction fees.
• Paid plans are offered to customers in every European Union country at the same price and on the same terms; access is not restricted and different terms are not applied because of your nationality, place of residence or the country where your card was issued.

Renewal

• Subscriptions renew automatically every month or year, depending on the period you choose, until you cancel. The renewal fee is charged to your saved payment method at the start of each period.
• If a payment fails, your subscription becomes past due and your plan stays open for a short grace period. If payment is not made in that time, your account returns to the free plan. Your data is not deleted; only the free plan limits apply.
• We may change prices. A change does not affect the period you are in. The new price is announced by e-mail at least 30 days in advance and applies from the next renewal. If you do not accept it, you can cancel before the renewal.

Changing plans

• When you upgrade, the new plan opens immediately and the price difference for the rest of the current period is charged straight away.
• When you downgrade, the change applies immediately and the difference for the unused part of the current period is refunded to your payment method.

Enterprise plan

The scope, fee, term and service level of enterprise use are set in a separate agreement signed by the parties. These Terms apply to anything that agreement does not cover.

Purchases through a Store

If a subscription is offered inside the mobile app with App Store or Google Play billing, that purchase is subject to the terms of the Store concerned, and payment, renewal, cancellation and refunds are handled through your Store account.

• You can cancel your subscription at any time in the Creem customer portal, which opens from the "Manage subscription" link on your account page. Cancellation takes effect at the end of the current period, and you keep your plan until then.
• No partial refund is given for the rest of a cancelled period. This does not affect your statutory rights below or the refund of the difference when you downgrade.
• A paid plan is a service that starts being performed electronically as soon as payment is confirmed. Under Turkish Consumer Protection Law No. 6502 and Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal may not apply to such services. The checkout page also informs you about this.
• If the Service cannot be provided at all, the features of the plan you paid for are not delivered, or you are charged twice, send your refund request to info@priceonn.com. We review it, and refunds found justified are made to your payment method through Creem.
• If you are a consumer living in the European Union or another country, the mandatory consumer protection rules of the country where you live continue to apply.

Only signed-in, real members can post in the community. You are responsible for what you post and for its lawfulness. The Community Rules form part of these Terms.

• You keep the intellectual property rights in your content. By posting it, you grant PriceONN a worldwide, non-exclusive, royalty-free and sublicensable licence to display, reproduce, format, translate and distribute it within the Service and in promoting the Service. The licence ends within a reasonable technical time after you delete the content or close your account, except for copies that remain in backups and in records we must keep by law.
• Your public profile, username, display name, profile image and posts can be seen by other users and visitors. Do not write personal information you do not want to share in your posts.
• Community posts may not contain investment advice, paid signals, copy trading or managed account offers, broker promotion, referral links or contact details.
• As a hosting provider under Turkish Law No. 5651, PriceONN is not obliged to check user content before it is published. We remove or disable access to content that is reported or found to be unlawful and cooperate with the competent authorities where required.
• Every post and profile has "report" and "block" options. Reports are reviewed by our team; content that breaks the rules is removed, and repeated or serious violations lead to suspension or closure of the account.
• What other users say in their posts is their own opinion and does not bind PriceONN.

When using the Service you agree not to:

• Collect market data, charts or content with automated tools (scraping), download them in bulk, republish, sell or use them in another service.
• Forward algorithmic signals, signal notifications or paid plan content to others; redistribute them through any paid or free group, channel, app or service or present them as your own service; or use this content to provide signal, advice or account management services to others.
• Access the Service other than through the official website and mobile apps, call its programming interfaces with unauthorised clients, or exceed its rate limits.
• Try to bypass, probe or disable the Service's security measures, plan limits, authentication or payment steps. If you want to report a security issue, write to us.
• Reverse engineer, decompile, copy or modify the software, except where the law expressly allows it.
• Do anything that slows down or interrupts the Service or prevents other users from using it, or spread malicious software.
• Use someone else's account, impersonate anyone, open fake accounts or artificially inflate engagement.
• Use the Service for market manipulation, pump and dump schemes or spreading misleading information.
• Use the Service for any purpose that breaks the law, the rights of others or these Terms.

All rights in the PriceONN name, logo, interface design, software, charting engine, indicator and pattern algorithms, texts and databases belong to the Company or its licensors. These Terms give you a non-transferable, non-exclusive and revocable licence to use the Service for personal, non-commercial purposes in line with these Terms.

Some market data is provided under licence from third-party providers and may not be redistributed. You may use chart screenshots for personal sharing and news purposes if you credit PriceONN as the source; you may not republish the data in raw or bulk form.

If you believe your intellectual property rights are being infringed through the Service, send a notice to info@priceonn.com that identifies the right, the address of the content and your contact details.

The Service works together with third-party services such as Google and Apple sign-in, the Creem checkout page and the Apple and Google notification services, and it may link to other websites. Those services are governed by their own terms and privacy policies. PriceONN is not responsible for third-party services, content or practices.

• We may add, change or remove features to improve the Service. If we remove an essential feature of your paid plan, we will tell you in advance; you may then cancel your subscription and ask for a refund of the fee for the remaining period.
• The Service may be interrupted temporarily for maintenance, security updates, data provider failures, infrastructure problems or force majeure. We announce planned maintenance in advance where we can.
• We do not guarantee that the Service will run without interruption or errors. Force majeure means natural disasters, epidemics, war, terrorism, widespread cyber attacks, failure of energy or communications infrastructure, decisions of public authorities and similar events beyond the reasonable control of the parties.

The Service is provided "as is" and "as available". No express or implied warranty is given about the accuracy, completeness, timeliness or fitness for a particular purpose of market data.

• PriceONN is not liable for investment decisions you make based on information in the Service, trades you make or do not make, missed opportunities, lost profits or losses caused by market movements.
• PriceONN is not liable for indirect losses caused by delayed, incomplete or incorrect data, by notifications that arrive late or not at all, or by interruptions to the Service.
• Our liability to paid plan users is limited to the total amount you paid for the Service in the 12 months before the loss arose.
• These limits do not apply in cases of intent or gross negligence, to harm to life or health, or in any other case where liability cannot be limited under Article 115 of the Turkish Code of Obligations No. 6098 or the mandatory rules of consumer law.

• You can permanently delete your account at any time from your account page, from the Account section of the mobile app or at priceonn.com/account/delete. Deletion cannot be undone; what is deleted is explained in the Privacy Policy and on the account deletion page.
• Deleting your account does not cancel a paid subscription automatically. Cancel your subscription in the Creem customer portal before you delete your account, or payments may continue. Subscriptions bought through a Store must be cancelled in your Store account.
• We may suspend or close your account if you break these Terms, the Community Rules or the law, behave in a way that harms the Service or other users, commit payment fraud, or if a competent authority requires it. Where the nature of the case allows, we warn you first and give our reasons.
• If we close your account without a material breach on your part, we refund the fee for the rest of your paid plan. No refund is given when an account is closed for a breach.
• You can appeal our decision by writing to info@priceonn.com; appeals are reviewed by a person.
• Provisions that by their nature should survive the end of the agreement, such as intellectual property, limitation of liability and dispute resolution, remain in force.

Your personal data is processed under the Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where it applies, the EU General Data Protection Regulation ("GDPR"). The Privacy Policy and the KVKK and GDPR Notice explain what data we process and why, who we share it with, how long we keep it and what your rights are. Marketing messages are sent only with your separate, explicit consent.

If you downloaded the mobile app from a Store, the following also apply:

• These Terms are between you and the Company only. Apple Inc. and Google LLC are not parties to them. The Company, not the Store, is responsible for the app and its content.
• The licence granted to you is a licence to use the app on Apple or Android devices that you own or control, as permitted by the usage rules of the Store concerned.
• The Company is responsible for maintaining and supporting the app. Apple and Google have no obligation to provide maintenance or support. For support, write to info@priceonn.com.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• The Company, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
• If a third party claims that the app infringes its intellectual property rights, the Company, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple has the right to enforce them against you as a third-party beneficiary.

We may update these Terms because of changes in the law, new features or business needs. We announce changes that materially affect your rights or obligations by e-mail and in the Service at least 30 days before they take effect. The current text is always published on this page with its effective date.

If you do not accept a change, you can delete your account and cancel your paid plan before the effective date. Continuing to use the Service after that date means you accept the change.

• These Terms are governed by the laws of the Republic of Turkey.
• If you are a party as a consumer, you may apply to the Consumer Arbitration Committee where you live or where the transaction was made, within the monetary limits set under Law No. 6502 and its regulation, or to the Consumer Court for disputes above those limits. Where the law requires, mediation must be tried before filing a lawsuit.
• For disputes with users who are not consumers, the courts and enforcement offices of Istanbul (Çağlayan), Turkey have jurisdiction.
• Consumers living in the European Union keep the benefit of the mandatory protections given to them by the law of the country where they live.
• In disputes, the Company's server, database and e-mail records are evidence within the meaning of Article 193 of the Turkish Code of Civil Procedure No. 6100. This does not take away your right to submit counter-evidence.

• If any provision of these Terms is held invalid, the other provisions remain valid, and the invalid provision is replaced by the valid provision closest to its purpose.
• If we do not exercise a right, or exercise it late, we have not waived it.
• You may not transfer your rights and obligations under this agreement without our written consent. The Company may transfer the agreement to a successor in a merger, transfer of business or demerger; your rights are protected in that case and you will be notified.
• Notices to you are sent to the e-mail address registered to your account or published in the Service. Use the addresses below for notices to us.
• These Terms are published in Turkish and English. If the two texts conflict, the Turkish text prevails.
